1. About these Terms

These Terms and Conditions govern your use of archidemia.com (the “Website”) and purchases made through it. By accessing the Website or placing an order, you agree to these Terms.

If you do not agree to these Terms, please do not use the Website or place an order.

These Terms do not affect any mandatory rights you may have under applicable consumer law.

3. Products and Website Information

We take reasonable care to ensure that product descriptions, images, prices, and availability information are accurate. However, colours, dimensions, packaging, specifications, and images may vary slightly from the products supplied.

We may correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. If an error affects your order, we will contact you and give you the option to proceed on the corrected terms or cancel the order for a full refund.

We may change or discontinue products, services, prices, or Website content at any time.

4. Orders and Contract Formation

When you place an order, you are making an offer to purchase the selected products. An automated order confirmation does not mean that we have accepted your order.

A contract is formed only when we confirm that your order has been accepted or dispatch the products, whichever occurs first.

We may refuse or cancel an order where reasonably necessary, including because products are unavailable, payment cannot be authorised, there is a pricing or product-description error, an order appears fraudulent, or delivery is not possible.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

5. Prices, VAT and Payment

Prices are shown in euros (€), unless another currency is displayed. Any currency conversion is provided for convenience only and the amount charged may vary according to your payment provider’s exchange rate and fees.

Whether VAT or other sales taxes are included in a displayed price will be shown at checkout. Additional taxes, customs duties, and import charges may apply to international deliveries; please see section 10.

Payment must be made using the payment methods offered at checkout. By submitting payment details, you confirm that you are authorised to use the chosen payment method.

We reserve the right to withhold dispatch until payment has been authorised and cleared.

6. Availability and Delivery

Orders within Spain may be dispatched from our Barcelona warehouse. International orders may be dispatched from our Barcelona or UK warehouse, depending on product availability and the delivery destination.

Any delivery timeframe shown on the Website or at checkout is an estimate, not a guarantee. Delays may arise from factors beyond our reasonable control, including courier delays, customs clearance, strikes, weather events, and supply-chain disruption.

Please ensure that the delivery address, email address, and telephone number provided at checkout are accurate. We are not responsible for delays or losses caused by incorrect or incomplete delivery information supplied by you.

Risk in the products passes to you when the products are delivered to the address stated in your order, except where applicable law provides otherwise.

7. Right of Withdrawal and Returns

If you are a consumer in the European Union or another jurisdiction that gives you a statutory right to cancel a distance purchase, you may have the right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason.

To exercise this right, you must notify us clearly by email at admin@archidemia.com before the withdrawal period expires. You must then return the goods without undue delay and, in any event, no later than 14 days after notifying us of your decision to withdraw.

Returned goods must be handled only as necessary to establish their nature, characteristics, and functioning, as you would in a shop. You may be responsible for any reduction in value caused by handling beyond this.

Unless we agree otherwise or applicable law requires otherwise:

  • You are responsible for the direct cost of returning goods.
  • Goods must be returned securely packaged, with all components, accessories, and documentation.
  • We may withhold reimbursement until we receive the returned goods or proof that they have been sent back.
  • We will refund the standard delivery cost where required by applicable law, but not any extra cost resulting from your choice of a more expensive delivery method.

For hygiene and product-integrity reasons, products supplied sealed or shrink-wrapped may not be returned once unsealed where the applicable legal exception applies. Injection manikins and similar training products may not be returned if they have been injected, tested, used, damaged, or are no longer in resalable condition.

Nothing in this section limits your statutory rights if a product is faulty, damaged, or not as described.

8. Digital Products and eBooks

Digital products and eBooks are supplied electronically.

Where you expressly request immediate access to digital content and acknowledge that you lose your right of withdrawal once supply begins, you will not have a right to cancel after access, downloading, or streaming has started, except where the digital content is faulty or applicable law provides otherwise.

If you experience a problem accessing a digital product, contact us at admin@archidemia.com with your order number and a description of the issue.

9. Faulty, Damaged or Incorrect Products

Please inspect your order when it arrives. If a product is damaged, faulty, incorrect, or missing, contact us as soon as possible at admin@archidemia.com and include your order number, photographs where relevant, and a description of the issue.

Where a product is faulty or not as described, you may be entitled to repair, replacement, price reduction, or refund under applicable law. Nothing in these Terms limits any legal guarantee or other mandatory consumer right.

10. Customs, Duties, Taxes and Import Charges

When ordering from Archidemia, you are responsible for ensuring that the products may be lawfully imported into the destination country.

For international orders, the recipient is the importer of record and is responsible for complying with all applicable laws, regulations, customs requirements, and documentation requirements in the destination country.

Unless expressly stated otherwise at checkout, import taxes, customs duties, VAT, brokerage fees, clearance charges, handling fees, and any other charges imposed by customs authorities or carriers are the responsibility of the recipient. These charges are not included in the product price or shipping cost.

We have no control over customs charges, import procedures, delays, or decisions made by customs authorities or carriers. We cannot predict, waive, reimburse, or accept responsibility for such charges.

If customs charges are not paid, or a shipment is refused, returned, or abandoned because of import restrictions, any refund will be assessed in accordance with these Terms and applicable law. Shipping costs, return shipping costs, customs charges, and other non-recoverable costs may be deducted where legally permitted.

11. Cancellations Before Dispatch

If you wish to cancel an order before it has been dispatched, contact us as soon as possible at admin@archidemia.com.

We will try to process cancellation requests, but cannot guarantee cancellation once an order has entered fulfilment or has been dispatched. Your statutory withdrawal rights, where applicable, are not affected.

12. Gift Vouchers, Promotional Codes and Discounts

Gift vouchers may be used only in accordance with their stated terms and are not redeemable for cash, except where required by law.

Promotional codes and discounts apply only where stated, may be subject to eligibility requirements, and cannot be combined with other offers unless we expressly say otherwise. We may withdraw or amend a promotion at any time before an order is accepted.

If a promotion includes a free item, that item has no cash value and may need to be returned if the qualifying order is cancelled or returned, where legally permitted.

13. Customer Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity carried out through your account.

You must provide accurate and current information and notify us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where we reasonably believe these Terms have been breached, fraud has occurred, or the account is being misused.

14. Acceptable Use of the Website

You must not use the Website unlawfully or interfere with its security, operation, content, or users.

You must not attempt to gain unauthorised access to the Website, introduce malicious code, misuse payment systems, scrape Website content without permission, or use the Website for fraudulent or unauthorised commercial purposes.

15. Reviews and User Content

If you submit a review, comment, image, or other content, you confirm that it is accurate, lawful, and does not infringe another person’s rights.

We may remove or refuse content that is abusive, defamatory, misleading, unlawful, irrelevant, or otherwise inappropriate.

16. Intellectual Property

The Website and its content, including text, images, logos, product information, design, and software, are owned by or licensed to Archidemia, S.L. and are protected by applicable intellectual-property laws.

You may use the Website for personal, non-commercial shopping purposes only. You must not copy, reproduce, distribute, modify, or exploit Website content without our prior written permission.

17. Third-Party Links

The Website may contain links to third-party websites for convenience or information. We do not control those websites and are not responsible for their content, availability, security, or privacy practices.

18. Privacy and Cookies

Our handling of personal data is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

Please read those policies before using the Website or placing an order.

19. Liability

We are not responsible for losses that are not reasonably foreseeable, for business losses suffered by consumers, or for losses caused by events beyond our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.

20. Force Majeure

We will not be liable for delay or failure to perform our obligations where caused by circumstances beyond our reasonable control, including natural disasters, war, civil unrest, strikes, transport disruption, pandemic, governmental action, supplier failure, or telecommunications failure.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain.

If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence. Nothing in these Terms removes any rights that cannot be excluded under applicable law.

Any dispute will be subject to the jurisdiction of the courts required by applicable law.

23. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time you place an order will apply to that order.
